Those who practice in the field of intellectual property face the traditional pressures of heavy caseloads, the complexity of cases and the need to keep up to date with new developments, legislation and case law in the UK, Europe and internationally. Nottingham Law School offers an IP Litigation course and an IP Advocacy course which can enable practitioners to meet these challenges and exercise rights before the new Patents County Court and before the Intellectual Property Court and on appeal. Designed for those who have at least two years experience in intellectual property litigation, the courses build upon students' existing knowledge and experience.

The courses will:

  • Develop high-level skills of reflection.
  • Enhance case analysis abilities.
  • Enhance drafting skills and abilities.
  • Enhance knowledge of the law of evidence and related practice.
  • Enable students to manage the litigation process including case management protocols in the Patents County Court and in the High Court and on appeal.
  • Enable students to gain experience of ADR and the importance of mediation as an ADR mechanism.
  • For those who are not litigators, it can provide knowledge and experience of the litigation process, in order to inform students' non-contentious work.

The courses are structured to minimise the time spent away from the office and are taught by a mix of assignments and attendance.

Study routes
Part-time over six months. The courses are built around intensive study units running from Thursday to Saturday, allowing work to be completed at a time that is convenient to the student.

Course content
The courses will be structured around intellectual property case studies.

Intellectual Property Litigation Certificate

Unit one: Case Analysis and Case Theory, Drafting and Case Preparation

The following topics will be covered:

  • case analysis and case theory
  • effective teams
  • drafting statements of case
  • client interviewing and management
  • evidence
  • disclosure
  • legal professional privilege and IP
  • professional conduct for IP litigators.

Unit two: Project and Case Management, Funding and Costing and Interim Applications

The following will be covered:

  • project management in IP litigation
  • cost and risk analysis
  • case management and work schedules
  • case management conferences
  • part 36 and offers
  • interim applications / injunctions / disclosure
  • drafting skeleton arguments.

Unit three: ADR, Witness Evidence, Trial Craft, Risk Analysis and Settlement

The following topics will be covered:

  • comparison and selection of ADR options
  • opportunity to take part in a mock mediation
  • techniques for interviewing witnesses
  • drafting witness statements
  • trial craft (preparation for trial)
  • risk analysis in litigation
  • settlement and appeals (including drafting settlement agreements).

The timing of modules 1-3 is as follows:
Day 1 – 10:00 (registration 09:30 - 10:00) until 18:00 (lunch is 45 minutes)
Day 2 – 09:00 until 18:00 (lunch is 45 minutes)
Day 3 – 09:00 until 17:00 (lunch is 45 minutes)

Intellectual Property Advocacy Certificate

The following will be covered:

  • case preparation for the advocate
  • opening statements
  • witness examination (chief / cross/ re-examination)
  • legal and evidential submissions
  • closing speeches
  • mock trial.

The timing of this module is as follows:
Day 1 – 10 am (registration 9.30 am - 10 pm) until 6 pm (lunch is 45 minutes)
Day 2 – 9 am until 7 pm (lunch is 45 minutes)
Day 3 – 9 am until 5 pm (lunch is 45 minutes) Evening: Preparation for the assessment on day four.
Day 4 – 15 minute individual assessment according to a timetable (which starts at 10.30 am) provided at the beginning of module 4.

Advocacy Assessment - TBC in July 2014

The following assessment methods will be used.

  • Written Paper in Intellectual Property Litigation: (three hours)
  • Advocacy Assessment: (15 minutes)
